BEI and the FEK have completed draft amendments to the Law “On Private Entrepreneurship” and presented them to MIT, recommending improved law-making procedures based on clear calculation of impact assessment and revised expert council working methods.
 
BEI participated on November 29th in the Almaty international conference “Entrepreneurship in Kazakhstan – A New Start' organized by the Kazakhstan Fund of Small Business Development.
 
After a BEI round table on November 27th with the Almaty Public Prosecutor’s Office, business associations, and state inspection bodies, the senior public prosecutor has suggested BEI to meet and further discuss its recommendations, for the law “On Private Entrepreneurship” regarding inspections.
 
On November 5-6, BEI Regional Technical Advisor – Private Sector Economic Growth, Ed Beaman, and Polish association specialist Margol Kshyshtov, with the support of the USAID Kazakhstan Small Business Development (KSBD), conducted trainings on association growth for representatives from BEI’s subcontractors and Almaty business association partners.

In collaboration with the Tax Committee and the Association of Taxpayers and Center for Study of Public Opinion, BEI conducted a national survey to evaluate the work of the tax committees.
 
BEI completed its first analysis of PSC operations and submitted it to the Ministry of Justice and all other participating parties on October 4th.

Since 1997, the Law 'On Bankruptcy' has been changed 3 times in Kazakhstan. In ten years, the legislative changes have been introduced 19 times, practically revising the whole articles and the concept of the law from its original state. Currently, the Government of Kazakhstan is plannning to introduce to the Parliament a draft law on changes and additions to the current legislation on bankuptcy.

On June 20, 2008 Jogorku Kenesh approved the draft law that determines list of government bodies that are authorized to conduct inspections of businesses.
 
In his speech at the meeting of Investment Council President Kurmanbek Bakiev made a suggestion today that businesses should be interviewed independently to obtain opinions of entrepreneurs on actions of controlling bodies. This was reported by Press Service of President.
 
The president Kurmanbek Bakiev has signed the laws, upgrading the indicators of Kyrgyzstan in the international rating at World Bank’s “Doing Business”. Particularly the following laws were signed: “On amendments to the Civil Code of KR; “On amendments and changes to the Law of KR “On Joint Stock Companies; On amendments to the Law of KR “On construction and architecture of KR”; On amendments and changes to the Law of KR “on State registration of the legal entities”.

Social Fund of KR resolved to ban scheduled inspections of businesses. “Exceptions are made for conducing desk inspections and raid inspections”, Social Fund’s official reports.
 
Two draft law concerning protection of investor’s rights and construction permitting were reviewed and approved on May 27, 2008 at the meeting of Committee on Development of Industry, Trade, Tourism, Small and Medium Enterprise, Transport, Communication, Construction and Architecture of Jogorku Kenesh of KR which was chaired by Member of Parliament Ulugbek Ormonov. The committee decided to submit the aforementioned draft laws for the review by the plenary session of Jogorku Kenesh by June 1, 2008.
 
A round table with participation of KR Government, Jogorku Kenesh and the business community was held on May 16, 2008 in Hyatt Regency Bishkek. At the meeting, Minister of Economic Development and Trade Akylbek Japarov made a presentation to members of Parliament about the results achieved by Government, the business community and experts within 75 days under 100 Days of Reform Program. According to the words of M. Ismailov, Head of Government Apparatus, Prime Minister signed a series of resolutions designed by Ministry of Economic Development and Trade in cooperation with thematic working groups and submitted the package of documents for review by Jogorku Kenesh of Kyrgyz Republic.
 
President Kurmanbek Bakiev signed on May 14, 2008 Decree “On Measures to Streamline Permitting Procedures for Designing and Construction in Kyrgyzstan”.

A seminar organized by Ministry of Justice with support of USAID Business Environment Improvement Project was held on April 28. The seminar was devoted to registration of legal entities using One Stop Shop principle. Organizers and participants of the event discussed Provision “On Order of Interfacing Government Bodies while Registering Legal Entities using One Stop Shop Principle” endorsed by Resolution of KR Government.
 
Expert Group on Starting Business indicator presented the results achieved in the framework of Action Plan following Resolution of Government of KR “On Bringing about Priority Actions of Government of KR towards Improving Indicators of KR under International Rankings” as of 04.04.08 # 126. In this relation, Government adopted a provision concerning the order of interfacing government bodies while registering legal entities.
 
On April 23, 2008, President of Kyrgyzstan Kurmanbek Bakiev held a meeting in House of Government with local entrepreneurs that represent public organizations, the business communityó and various businesses.
 
The President Kurmanbek Bakiev set a moratorium on business enterprise inspections held by state fiscal agencies. The president has signed a relevant order today.
 
President of the Kyrgyz Republic Kurmanbek Bakiev signed the Law “On Streamlining Normative Legal Framework Regulating Entrepreneurial Activities”.

Investment Council (IC) under President of KR notes positive shifts in improving business environment and intends to consider implementation of the new plan proposed by KR Government on reducing constraints for business at the next meeting as reported by IC Secretariat today, March 28, 2008.
 
Government is intended to establish an interagency working group to contemplate action plan for primary directions of the state policy in the area of business environment improvement. The respective resolution of Government was signed by Prime-Minister Igor Chudinov.
 
Seminar on the methodology of regulatory impact analysis, organized by the President’s Administration and USAID Business Environment Improvement project was held on 22 March, 2008 in Bishkek.
 
Prime Minister of KR, Igor Chudinv has signed a Government Resolution for the draft law of KR “On making changes and amendments to the KR Code on administrative liability”.
 
On March 17-19, 2008 Osh branch of the International Business Council (IBC) and Osh Province State Administration with a financial support from USAID BEI Project implemented by Pragma Corporation presented Booklet for Entrepreneurs and Local Self-Governance Bodies on Sale of Land Plots for Commercial Use in the Karasu, Uzgen and Naukat districts of the Osh Province.
 
A scheduled meeting of Investment Council under the President of KR took place on March 14, 2008 in the KR House of Government. The meeting was held under the chairmanship of Prime-Minister Chudinov following the instructions of President Kurmanbek Bakiev.
 
At the Collegiate meeting of Ministry of economic Development and Trade that was held erlier today Minister Japarov said that Kyrgyzstan must join top 20 countries in Doing Business Ranking in 2 years.

Improving Capacity of Ministries and Agencies in Interaction with the Parliament of the Kyrgyz Republic (Zhogorku Kenesh) workshop was held in Bishkek on March 12, 2008 by the Government Apparatus and USAID Business Environment Improvement Project.
 
Bell Program will be launched in short at the initiative of Akylbek Japarov, Minister of Economic Development and Trade. This program includes organization of mobile groups on prevention of interference by controlling, law-enforcement and other government bodies to operations of business. Any entrepreneur will be able to submit complaints concerning illegal inspections to mobile groups.
 
The Ministry of Economic Development and Trade of Kyrgyzstan (MEDT) proposes to record all cases of corruption using TV cameras. Akylbek Japarov, MEDT Minister, described these proposals under the “Kolokol” program at today’s round table.

On February 29, specialists of ministries and agencies attended the last training session on Regulatory Impact Analysis (RIA) methodology. Among priorities in development of entrepreneurship in Kyrgyzstan, people site One Stop Shop principle for registration of legal entities. Reforms in this area were tasked to Ministry of Justice. According to the words of Deputy Minister of Justice Bekbolot Bakiev, “implementation of the principle will improve investment attractiveness of the country and simplify red-tape procedures for entrepreneurs.” Minister of Economic Development and Trade Akylbek Japarov also supports prompt transition to One Stop Shop principle. In addition, these prominent reforms are incorporated in the body of Country Development Strategy paper. What is the essence of this principle and what problems it is meant to address in the market-based economy of Kyrgyzstan? on February 18, President of KR Kurmanbek Bakiev met Elmurzu Satybaldiev, Prosecutor General of KR who informed the Head of the State on results of work carried out by Collegiate Body in his agency and objectives taken by Prosecutor General’s Office for the current year.
 
On February 16, Christian Philipov held a presentation on Regulatory Impact Assessment (RIA) methodology for officials from Presidential Administration of the KR.
 
Following the request of Igor Chudinov, Prime-Minister of the KR, USAID Business Environment Improvement Project provides advice to Government of the KR to streamline decision making procedures and introduce new methods that will allow increasing the quality of the very decision making.

On January 23 and 24, 2008, the Bishkek Mayor’s Office, Ministry of Economic Development and Trade of the Kyrgyz Republic, and business associations explained the new procedures for conducting inspections of businesses to entrepreneurs in presence. The 2-day meeting was attended by 200 entrepreneurs and representatives of the state controlling bodies. The meeting was held under support of the USAID Business Environment Improvement Project.
 
On January 23, 2008, leading independent experts, lawyers and business associations met in Bishkek to discuss the idea of creating and developing an institution for settling business disputes upon the initiate and under support of the USAID Business Environment Improvement Project.
 
On January 18, 2007, USAID Business Environment Improvement Project conducted the training workshop in Osh on Application of Regulatory Impact Analysis (RIA) Methodology for the business community The objective of the workshop was to present RIA methodology and familiarize consultants from business associations with procedures to conduct analysis in order to prepare recommendations and comments regarding normative legal acts developed by variuos state bodies.
 
Draft law “On optimization of regulatory legal base of entrepreneurial activity” was approved by the committee for development of industry, trade, tourism, small, medium business, transport, communication, construction and architecture. Experts from USAID Business Environment Improvement project took active part in developing this draft Law.
 
January 17, 2008, CA-NEWS (KG) – During whole year 2007, the Department for Entrepreneurial Support of Bishkek Mayor’s Office together with USAID Business Environment Improvement Project conducted numerous visits to meet with representatives of sewing shops to promote incentivized transition to a patent basis in order to legalize the sewing industry.
 
On January 11, 2008, representatives of the controlling bodies, international organizations, legal and business community met at the Ministry for Economic Development and Trade of the KR to discuss consistency issues and develop recommendations related to the Law of the Kyrgyz Republic on Procedure for Conducting Inspections of Businesses. The roundtable was arranged with support from USAID Business Environment Improvement Project.

On December 21, 2007, Acting Prime Minister of the Kyrgyz Republic Aidaraliyev signed Resolution of Government of the Kyrgyz Republic ¹602 “On Approval of Methodology for Conducting Analysis of Regulatory Impact of NLAs on Activities of Businesses.”
 
The business community encourages all parties to pay special attention to enhancing the economic part of their programs. The correspondent announcement was distributed today by International Business Council and Entrepreneurs’ Union of Kyrgyzstan. Both organizations express their eagerness to cooperate with all political organizations to improve business environment in the country.
 
Acting Head of Government Apparatus (GA) Murat Ismailov signed a resolution on establishing a working group to implement decisions that had been taken at the Food Security Council Meetings on November 8 and 12, 2007.

On November 30, the working commission of the Consultative Council under the General Prosecutor of Kyrgyzstan approved the directions of its activities. This information is given by the press service of the International Business Council.
 
Today, on November 28, 2007, the President Bakiev signed a decree, according to which Almazbek Atambev is resigned from the position of the Acting Prime-minister of Kyrgyz Republic in connection with the transfer to another job.
 
Almazbek Atambaev, acting Prime Minister of the Kyrgyz Republic, held another meeting of Food Safety Council of the Kyrgyz Republic on November 12, 2007. Several decisions were made during the meeting.
 
Entrepreneurs that participated in the round table on November 9, 2007 adopted a resolution which proposes 23 recommendations to improve investment climate.
 
On November 8, 2007, representatives of the business community held a press conference in order to share results of a survey that had been conducted among entrepreneurs of Bishkek and present a brochure for entrepreneurs.

On October 18, 2007, at Government House, the members of the Kyrgyz Government discussed the draft Provision on realization of the Law of Kyrgyz Republic “On Procedure for Conducting Inspections of Businesses”. This provision was developed and presented by the group of experts under the Special Commission, which is chaired by the Prime-minister of KR, Atambaev A.Sh.
 
Many domestic and foreign experts consider revolutionary the Law “On Procedure for Conducting Inspections of Businesses” signed by the President Kurmanbek Bakiev in May of this year. The extent to what the Law will be enforced successfully is now dependant on the implementation mechanisms of thereof. As we have reported earlier, a special government commission that had initiated and headed by Almazbek Atambaev commenced the work on designing such mechanisms. What is the essence of innovations and why those cause such an ambiguous reaction among government officials? These issues are uncovered in the interview by our correspondent with Tatyana Kim, the economist who is famous in the Kyrgyz Republic.
 
On 4 and 5 October, the USAID Business Environment Improvement project together with Ministry of Economic Development and Trade held a seminar titled as “Practice of Implementing a Regulatory Impact Analysis for Normative Legal Acts”. The participants of the seminar were representatives of ministries and agencies of economic, social, and, financial, law enforcement and armed forces sectors.
 
The first meeting of a Consultative Council under General Prosecutor’s Office of the Kyrgyz Republic took place on October 3, 2pm. in Hyatt Regency Bishkek. The meeting was dedicated to the interaction of General Prosecutor’s Office bodies with the business community in building an enabling business environment. The event was organized by joint efforts of International Business Council and other business associations of the country under support of USAID Business Environment Improvement Project in the Kyrgyz Republic.

Entrepreneurs and interested parties have an access for judicial opinions and legal system - Central Asian Legal Library
 
Yesterday, on September 24 the representatives of private sector and state bodies of Kyrgyzstan met to discuss two versions of the code in Bishkek . The first reduction was designed by Government, while the second document by the business community at the initiative and under support of a group of the Jogorku Kenesh members.
 
On September 20, 2007, Prime Minister Atambaev held the expert commission meeting in House of Government dedicated to designing mechanisms for implementation of the Law “On Procedure for Conducting Inspections of Businesses”. In the course of the meeting members of the commission discussed a work of the expert group which had reviewed moreover 200 normative legal acts regulating inspections.
 
On September 14, 2007, the Ministry for Economic Development and Trade of the Kyrgyz Republic (MEDT), led the first meeting of the Council on issues of entrepreneurship which comprises leaders of business associations. The council started its work from official opening of ceremony of the public reception Center for business, where businessmen can use the legal protection and consulting services for business development.

A meeting of the Expert Commission led by Prime Minister Almazbek Atambaev was held in the House of Government on August 20. The event was dedicated to designing mechanisms for implementation of the Law of the Kyrgyz Republic “On Procedure for Conducting Inspections of Businesses” and the Law on “State Support to Small Enterprise”.
 
On August 7, 2007 President Bakiev held the second meeting of Investment Council in the House of Government in Bishkek. Prime Minister Atambaev, Head of Presidential Administration Sadyrkulov, Minister of Economic Development and Trade Moldokulov, Minister of Foreign Affairs Karabaev, and representatives of international donor organizations and local business associations participated in that meeting.

On July 24, Minister of economical development and trade of Kyrgyz Republic, Mr. Moldokulov S.A chaired the meeting of experts on discussion of the work plan concerning the law on “Procedures for conducting inspection of Businesses”. Head of the Government office, Mr. Ismailov M.A., attended the discussion as well as other government representatives, business entities, USAID/BEI project and independent experts. The meeting took place at the Ministry of economical development and trade of Kyrgyz Republic
 
On June 23, 2007, Kurmanbek Bakiev, President of the KR signed the Decree “On Certain Measures to Streamline a Permits Regulatory System in the Kyrgyz Republic”.

New Law on Inspections
Two months ago the President signed the Law “On the Procedure for Conducting Inspections of Businesses”. The Law has not become effective yet. This will take place in September 2007 i.e. in three months after the Law was published.
 
The Main Objective of the Coordination Council Established under the Ministry of Economic Development is to Assist Local Businesses in Resolving Various Issues Arising while Dealing with the State.
 
The Government decided to help a business in establishing clear and intelligent rules of interactions with the State. A commission was established comprising members of the Government and a business on designing mechanism for implementation of the Law of the Kyrgyz Republic.
 
The draft Law submitted in the early June for President's approval made many businessmen and government officials feel uneasy. Some of them eagerly waited for the Draft to be approved but did not believe that it will be signed, while the others expected its signing with fears. The largest business association of the country, including Union of Entrepreneurs of Kyrgyzstan, International Business Council, Bishkek Business Club and others addressed Almazbek Atambaev, the Prime Minister of Kyrgyzstan.
 
On July 16 2007, Ministry of Justice of the Kyrgyz Republic and USAID Business Environment Improvement Project signed Memorandum of Understanding and Cooperation in the area of business environment improvement through simplifying the registration, re-registration, and deregistration of business entities.
 
The Law “On the Procedure for Conducting Inspections of Business Entities” which establishes the order for conducting inspections will come into effect in three months.
 
The internal documents of the Council were approved and foreign trade issues discussed during the meeting.
 
Almaz Atambaev, the Prime Minister of Kyrgyzstan signed a resolution of the Government “On Ratification of Kyrgyz-Kazakh Intergovernmental Framework Agreement” concerning establishment of “Auhatty – Ken-Bulun” and “Aisha Bibi – Chon-Kapka” international border service cooperation centers.
 
As reported by Ferghana.ru Informational Agency, in the end of last week Mr. Almazbek Atambaev, the Prime Minister of the Kyrgyz Republic conducted the third, conclusive meeting of the Commission on Designing Proposals for Optimization of Administrative and Territorial Organization of Kyrgyzstan for 2006-2011.
 
The President of the Kyrgyz Republic, Kurmanbek Bakiev, signed Decree “On Measures to Improve Procedure for Conducting Inspection of Businesses”.

On June 29, 2007, the Supreme Court of the Kyrgyz Republic and the United States Agency for International Development (USAID) signed their third Memorandum of Understanding (MOU) so that cooperation between the two organizations will continue in the area of Judicial Reforms. Implementing the project activities on behalf of USAID is the Pragma Corporation through the Business Environment Improvement Project (BEI).
 
On June 14, Mr. Elmuraz Satybaldiev, the General Prosecutor of the Kyrgyz Republic, met business community representatives and discussed important issues concerning establishment of favorable investment climate and protection of businesses’ rights. Responsible officers of General Prosecutor’s Office, government agencies’ staff, representatives of Communication Operators Association, Union of Entrepreneurs of Kyrgyzstan, International Business Council, and International Organizations participated in this meeting.

Business associations are concerned about the fate of the Law of the Kyrgyz Republic “On Procedure for Conducting Inspections of Businesses” currently pending President’s signing. Businesses believe that should the Law be signed, it will serve as a significant proof of the fact that authorities are willing to protect business not through mere declarations, but undertake specific practical steps in this direction.
 
President of the Kyrgyz Republic Kurmanbek Bakiyev signed a Decree where the list of activities is indicated that are aimed at realizing the citizens’ right to access to information possessed by state bodies. This Decree has been prepared to implement the Law of the Kyrgyz Republic “On Access to Information Maintained by State Bodies and Local Self-Governance Bodies of the Kyrgyz Republic”
 
The 1st meeting of the Investment Council under President of the Kyrgyz Republic was held in Bishkek that reviewed issues relevant to the enterprise and pertaining to the elimination of unsubstantiated inspections of businesses by state bodies and the reduction of permits restricting the operations of businesses.

The Round Table was devoted to detailed discussions on several key issues facing the industry and will be broadcast on independent television of Tajikistan (“Simoi Mustakili Tojikiston”)
 
Recently a conference to discuss the creation of a Custom Consultative Council under the Customs Service under the Government of the Republic of Tajikistan took place in Dushanbe. Top Management of the Customs Service, representatives from the Executive Body of the President, Chamber of Commerce and Industry and representatives from other ministers and agencies participated in the conference
 
The results of the the IFC analysis of the system of issuing permits were presented on April 16 in Dushanbe. Representatives from the Government, International Organizations, private sector and mass media participated at this conference

Round Table 'Taxation'
On April 11, 2008 National Association of Small and Medium Business of Tajikistan jointly with the Department on Investment and State Property Management of Sogd oblast and Union of Business Associations of Sogd Oblast under USAID/BEI Project conducted a Round Table “Taxation”.
 
The State Investment Committee of the Republic of Tajikistan jointly with the IFC Project “Tajikistan Business Enabling Environment (BEE)” has created a joint working group which will coordinate cross-cutting donor activities designed to improve enterprise activity in the country.
 
The First Round Table on tax issues was conducted within the terms and conditions of a grant implemented by NASMB under the financial and technical support of the USAID/Business Environment Improvement Project implemented by the Pragma Corporation on April 4, 2008 in Kurgan-Tube.
