The USAID BEI Project and the Forum of Entrepreneurs of Kazakhstan in cooperation with the Ministry of Economy and Budget Planning RK have conducted the Round Table session on the 20-th January, 2010. The developers of the Draft Law have presented the following themes for discussion- namely reformation of the procedures for carrying out the inspections according to the system of risk management and the results of realization of amendments and addenda to the RK Law “On Private Entrepreneurship”. Except above there was presented the Concept of improvement of the permit system in the Republic of Kazakhstan.

Kazakhstan has been undertaking reforms in the past 12 months to make it easier to do business. The reforms are inspired by the Doing Business report, published annually by the World Bank and IFC. The report compares business regulation in 181 economies.

Reform monitoring of USAID BEI and EREC Project-recommended administrative improvement by the Tax Committee of Kazakhstan to introduce tax services standards show satisfaction rates among businesses have doubled and service wait times have been reduced by 40% between 2007 and 2008. The Tax Committee plans further improvements by 2012 as outlined in their Order #110 of April 6, 2009.

At the regular meeting of the Expert Group on review and optimization of permitting documents held on June 4 in Astana, the Ministry of Emergency has eliminated 80% of permitting documents.

The Government of the Republic of Kazakhstan is actively supporting the development of private enterprise taking measures to minimize the effects of the global economic crisis. As part of this a new Tax Code became effective January 2009 that reduces the tax burden on businesses.

The research was conducted in the framework of “Research of Problems and Development Prospects in the Area of Retail Trade in the Republic of Kazakhstan” project implemented by the Forum of Entrepreneurs of Kazakhstan with the BEI grant program support.

Expert Group (EG) on review and optimization of permitting documents continues to improve permitting system in RK. Each ministry inventories permitting documents in their sphere and presents the results to the EG for review. Then the EG members vote and compose the final list of documents to be eliminated and those to be effective in future.

On April 30, the first meeting of the Expert Group on review and optimization of permitting documents headed by Kussainov M.A., Vice-Minister of Economy and Budget Planning, was held in Astana. Among the members of the Expert Group (EG) are representatives of state bodies, public organizations and the BEI Project.

One crucial problem for Kazakhstan’s entrepreneurs remains the effects of the permitting system on business activity, this despite the refinements introduced in 2007 by the Law on Licensing that reduced national licenses and sublicenses to 347, but retained several thousand ministerial and agency normative legal acts imposing controls on the business environment.
|
|
|
On April 22, 2009, President Nazarbayev signed amendments recommended by USAID’s BEI Project to the Law on State Registration of Right for Real Estate and Transactions, which eliminate a conflict between normative legal acts and the Constitution and will help protect property rights for Kazakhstan’s citizens.
|
|
|
The BEI Project closely collaborates with the Justice Department and the Public Service Center (PSC) of South-Kazakhstan Oblast (SKO) in pursuit of its activities to strengthen effective dialog between businesses and state bodies, and to optimize administrative procedures in behalf of small and medium enterprises.

The BEI partner in South-Kazakhstan Oblast (SKO), Business-Incubator “SodBi”, continues to improve the local-level business environment. Through reasonable recommendations SodBi successfully eliminates not only existing administrative barriers for business development, but works to prevent adoption of changes that would negatively affect entrepreneurs.

|
|
Since January 1, 2009, according to the Government Decree #116-IV from 29 December 2008, small, medium and large enterprises are exempted from payment for additional electric power connection. The payment was introduced as a recovery of energy delivery and transmission organizations’ expenses associated with expansion and reconstruction of electric plants.

The Ministry of Industry and Trade of RK in closely collaboration with the USAID Business Environment Improvement Project (BEI) developed the concept for the draft Law “On amendments and additions to legal acts of RK for regulation and optimization of inspections in the area of private enterprise”. The Concept is already included into the Project Laws Plan for 2009. Now the Concept is being discussed with the private sector.

The World Bank “Doing Business” 2009 report was issued in September. The Republic of Kazakhstan is ranked in this report in a comparable high position in the overall ratings of doing business, placed 70th out of 181 economies, an improvement of 10 positions from last year. Among countries in Eastern Europe & Central Asia, Kazakhstan’s position is middle (12 out of 25).

On July 24 2008 in Akimat of Almaty, a seminar on licensing took place. It was devoted to implementation of “one-stop-shop” principle during licensing all over the country. This event was initiated by the Ministry of Economy and Budget Planning of RK and its’ aim is to study experience of the Department of Economy and Budget Planning of Almaty and develop standard procedures for all licensor-bodies of RK.

Restricted access to normative and legal base of the local executive bodies is one of the most frequent informational barriers for entrepreneurs. Officials often refer to decrees or decisions of local executive bodies and don’t fulfil their commitments or use bad awareness of applicants to delay decisions. It takes minimum two weeks to obtain official elucidation or access to the normative acts, and according to unofficial data, it is not possible as “the information is for internal use only”.

BEI and the FEK have completed draft amendments to the Law “On Private Entrepreneurship” and presented them to MIT, recommending improved law-making procedures based on clear calculation of impact assessment and revised expert council working methods.

BEI participated on November 29th in the Almaty international conference “Entrepreneurship in Kazakhstan – A New Start' organized by the Kazakhstan Fund of Small Business Development.

After a BEI round table on November 27th with the Almaty Public Prosecutor’s Office, business associations, and state inspection bodies, the senior public prosecutor has suggested BEI to meet and further discuss its recommendations, for the law “On Private Entrepreneurship” regarding inspections.

On November 16, 2007, at 10:00 AM in the city of Uralsk a round table was held in the VIP conference hall of Shagala Hotel dedicated to the paperwork pertaining to permits related to land plots for new construction and reconstruction of facilities.

Since 1997, the Law 'On Bankruptcy' has been changed 3 times in Kazakhstan. In ten years, the legislative changes have been introduced 19 times, practically revising the whole articles and the concept of the law from its original state. Currently, the Government of Kazakhstan is plannning to introduce to the Parliament a draft law on changes and additions to the current legislation on bankuptcy. |

Kyrgyzstan joined top 50 countries in ranking under Doing Business Survey and holds 41nd position. Moreover, the country was acknowledged as the second most active reformer despite increased competition and high quality reforms observed during the previous year. In 2009 Doing Business scoped 183 countries (as opposed to 181 in 2008) of which 130 (against 113) implemented comprehensive reforms. This year there have been 287 projects bringing comprehensive reforms (against 239), which is 20% higher if compared to 2008.

Minister participated in Doing Business Reformers' Club, where he reported on Scenarios Workshop The Road to 2020: Scenarios for a World in Crisis. According to his words, our country’s successes symbolize economic renaissance.

Two months ago the President signed the Law “On the Procedure for Conducting Inspections of Businesses”. The Law has not become effective yet. This will take place in September 2007 i.e. in three months after the Law was published.

The draft Law submitted in the early June for President's approval made many businessmen and government officials feel uneasy. Some of them eagerly waited for the Draft to be approved but did not believe that it will be signed, while the others expected its signing with fears. Local businesses have been lobbying this normative act for four years. Government officials tried to block it at every level, the most active in this efforts were tax inspectors… The document, whose analogs already exist almost in every country of the CIS, imposes a real threat on local bureaucrats - it has significantly reduced chances that their palms will be greased to the same extent
